Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of Planet-B, the permanent archive of human contribution, together with our websites, the Planet Passport, Planet-B Studio, and any related services (collectively, the “Services”). Please read them carefully. By creating an account or otherwise using the Services, you agree to be bound by these Terms.

1. Agreement to these Terms

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you are using the Services on behalf of an organisation, you represent that you have authority to bind that organisation, and “you” refers to both you and that organisation. If you do not agree, you must not use the Services.

2. Who we are

Planet-B is a cultural-preservation initiative operating the Permanent Archive of Human Contribution (“Planet-B,” “we,” “us,” or “our”). Our mission is to preserve humanity’s creativity, culture, and climate contributions so that future generations can discover, learn from, and build upon them.

3. Definitions

  • Planet Passport — your permanent digital identity and record of contribution on Planet-B.
  • Contribution — any content, work, record, or material you submit, publish, or preserve through the Services, including art, writing, research, cultural and climate projects, and related metadata.
  • Archive — the curated, long-term preservation environment in which Contributions are held.
  • Studio — the tools that let you create, publish, and manage your Contributions.

4. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) and have the legal capacity to enter into these Terms to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. You are responsible for ensuring that your use of the Services is lawful where you are located.

5. Your Planet Passport and account

To preserve Contributions you must create a Planet Passport. You agree to provide accurate, current, and complete information and to keep it up to date. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us promptly at security@planet-b.tech if you suspect unauthorised use. We may refuse, suspend, or reclaim any account or identifier at our reasonable discretion, including where required by law or to protect the integrity of the Archive.

6. Your Contributions and the licence you grant

You retain ownership of the intellectual-property rights in the Contributions you submit. Planet-B does not claim ownership of your work.

To operate and sustain a permanent archive, you grant Planet-B a worldwide, non-exclusive, royalty-free, sublicensable licence to host, store, back up, reproduce, adapt (for formatting and preservation), publish, and display your Contributions and associated metadata, solely as needed to provide, preserve, and promote the Services and the Archive, and to the extent permitted by your visibility settings. This licence is perpetual with respect to Contributions you have chosen to make part of the permanent public Archive (see Section 8).

You represent and warrant that you own or have all necessary rights, consents, and permissions to submit each Contribution and to grant the licence above, and that your Contributions do not infringe or violate the rights of any third party or any law.

7. What is public, and what is private

You control the visibility of your Contributions. Content you mark as private is not published to the public Archive; content you publish becomes publicly discoverable. Do not submit confidential or sensitive information you do not wish to be preserved or, where you choose, made public. Please review our Privacy Policy for how we handle personal data.

8. The permanent Archive and removal

Preservation is the core purpose of Planet-B. By design, Contributions you publish to the permanent Archive are intended to endure, and verified records, certificates, and Passport entries may be maintained as a durable historical record. As a result:

  • You may unpublish or restrict future access to a Contribution, but copies, references, backups, and derived records may persist within the Archive and its preservation systems.
  • We may decline to remove content where doing so would compromise the integrity, authenticity, or historical completeness of the Archive, subject to your legal rights (including the data-protection rights described in our Privacy Policy) and applicable law.
  • We may remove or restrict content that violates these Terms, infringes rights, or is unlawful.

9. Acceptable use

You agree not to, and not to permit others to:

  • use the Services in violation of any law, regulation, or third-party right;
  • submit content that is unlawful, infringing, defamatory, hateful, harassing, deceptive, or fraudulent;
  • impersonate any person or entity or misrepresent the origin or authorship of a Contribution;
  • upload malware, or attempt to disrupt, overload, or gain unauthorised access to the Services;
  • scrape, harvest, or systematically extract data except as expressly permitted;
  • circumvent access, security, or preservation controls, or misuse verification, certificates, or badges.

10. Intellectual property of Planet-B

The Services, including the Planet-B name and marks, the Eye symbol, software, design, and the organisation and curation of the Archive, are owned by or licensed to Planet-B and are protected by intellectual-property laws. Except for the rights expressly granted to you, we reserve all rights. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them without obligation to you.

11. Third-party services and links

The Services may integrate or link to third-party products, content, or websites that we do not control. We are not responsible for third-party services, and your use of them is governed by their own terms and privacy policies.

12. Fees, wallet, and payments

Core preservation features may be offered free of charge. Where the Services include paid features or an in-platform balance or wallet, the applicable prices, terms, and any identity-verification requirements will be disclosed to you before you incur a charge. You are responsible for any taxes associated with your use of paid features. Except where required by law, fees are non-refundable.

13. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. While preservation is our purpose and we take reasonable measures to protect the Archive, we do not warrant that the Services will be uninterrupted, error-free, or that any storage medium will be immune from loss. You are encouraged to retain your own copies of important work.

14. Limitation of liability

To the maximum extent permitted by law, Planet-B and its officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Services. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Services will not exceed the greater of the amounts you paid us in the twelve months before the claim or one hundred US dollars (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Planet-B and its officers, employees, and partners from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your Contributions, your use of the Services, or your breach of these Terms or any law or third-party right.

16. Suspension and termination

You may stop using the Services at any time and may request account closure. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Services, other users, or the integrity of the Archive. Sections that by their nature should survive termination (including ownership, licences granted for preserved public Contributions, disclaimers, limitation of liability, and indemnity) will survive.

17. Governing law and disputes

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-law rules, and the courts located in Abuja, Nigeria will have jurisdiction, except where mandatory local law grants you the right to bring proceedings in your place of residence. Nothing in these Terms limits any non-waivable statutory rights you have as a consumer.

18. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by posting a notice on the Services or updating the date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

19. General

These Terms, together with the Privacy Policy, are the entire agreement between you and Planet-B regarding the Services. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or reorganisation.
